Sales Contract and Health Guarantee

All puppies are sold with limited registration (no breeding rights).

The breeder/seller guarantees this dog to be in good health at the time of sale.

The purchaser agrees to take this dog to a licensed veterinarian of purchaser’s choice and at the purchaser’s expense within 72 hours of purchase for a health check. Should the dog be determined to be in ill health within 72 hours and the cause is clearly attributable to the seller by this veterinarian, presentation of a written diagnosis from said veterinarian must be submitted to seller within 24 hours of the determination by the veterinarian. The dog may be returned for refund of purchase price or for another dog of equal value, the choice of which is to be determined by the breeder/seller. Seller is not responsible for vet costs or treatment, if buyer chooses to keep the puppy.

This health guarantee covers genetic Hip Dysplasia and Progressive Retinal Atrophy (PRA) for this dog until age two. To qualify for a replacement the following conditions must be met:

  1. In the event of unsoundness, verification from CERF and preliminary OFA must be received to determine that it is indeed a genetic problem and not the result of diet or environment. If it is so determined, the dog will be returned for a refund of purchase price or for another dog of equal value, the choice of which is to be determined by the breeder/seller. The buyer is responsible for any and all costs incurred by these examinations.
  2. If you and your vet determine it is in the best interest of the dog to be euthanized, the seller must be contacted beforehand.
  3. In the event of a death on or before the guarantee expiration, a necropsy report is required from a licensed vet stating that the dog passed as a result of a genetic default, and not caused by the purchaser, deliberate or accidental. In such case, the seller will provide purchaser with a replacement puppy of equal value from current or future litter when available. No monies will be exchanged.
  4. The dog must not have been used for breeding until x-rays and preliminary eye-check is made. Guarantee is void if this is not done.
  5. Purchaser must pay the difference between initial purchase price and the price of a replacement if applicable. All transportation costs are the responsibility of the buyer.
  6. If the purchaser chooses to keep an unsound dog, the dog must be spayed or neutered at the purchaser’s expense and the registration papers returned to the breeder/seller. No refund or exchange will be made if purchaser chooses to maintain ownership.
  7. This guarantee is offered to the original purchaser only. If a sale or transfer of this dog becomes apparent, this guarantee is null and void.

Any veterinarian’s diagnosis will be subject to confirmation by a veterinarian chosen by the breeder/seller and at the breeder’s/seller’s expense. Should such veterinarian not concur with the diagnosis, the matter shall be presented to a third veterinarian mutually agreed upon by the breeder/seller and the purchaser within five (5) days. The expense of the third veterinarian will be split equally between the breeder/seller and the purchaser. The decision of the third veterinarian is binding.

Replacement dogs are breeder’s choice of equal quality as soon as possible.
